On a Constitutional Basis, and based on the Common Law developed on 1st Amendment issues, this seems like a good idea. Secular courts aren't supposed to determine religious issues and who can marry whom seems to be something better left to Bet Dins and Diocesan Marriage Tribunals.

Let the various faiths define marriage, with some laws retained related to Parens Patria/Public Health (no marrying your relatives or your pets and its better to fail your Wassermann than never to have loved at all, to be sophomoric). Seems to avoid "entanglements" with religious law.
